Home and Business Marketplace — Terms of Service

1. Introduction & Platform Nature
Welcome to Home and Business Marketplace (accessible via homeandbusinessmarketplace.com). By accessing our website, creating a seller account, or utilizing our services, you agree to comply with and be bound by these Terms of Service.
CRITICAL PLATFORM NOTICE: Home and Business Marketplace is strictly a digital directory, advertising gateway, and connection platform linking independent sellers with independent buyers. We are NOT a transaction intermediary, auctioneer, escrow agent, or retailer. We do not hold user funds, process checkout balances, facilitate deliveries, or control transactions. All buying, selling, payments, and product handovers occur entirely off-platform, directly between the buyer and the seller.
2. User Eligibility & Account Security
- Age Requirement: You must be at least 18 years of age to register an account or list items.
- Verification Data: You agree to provide accurate, current, and complete details during registration (including matching your registered Safaricom mobile phone identity).
- Account Liability: You are uniquely responsible for maintaining the confidentiality of your credentials inside the seller portal.
3. Subscription Packages, Billing, and Downgrades
- The Tiers: We offer three distinct tiers: a 5-listing Free Plan, a 350-listing Trusted Merchant Plan (KES 1,000/month), and an Unlimited Verified Supplier Plan (KES 3,500/month).
- Payment & Renewal: Paid packages are billed upfront on a recurring monthly or annual schedule. Fees are non-refundable once a billing cycle has commenced.
- Listing Expirations: Free tier listings automatically expire and revert to a draft state after 14 days unless manually renewed by the seller.
- Automatic Downgrades: If a paid subscription payment fails or is canceled, the account will be automatically downgraded to the Free Tier. If your active listings exceed five (5) items at the time of downgrade, your system inventory will be programmatically truncated, hiding all items except your five oldest active listings.
4. Prohibited Items and User Conduct
Sellers are strictly forbidden from listing the following items on Home and Business Marketplace:
- Counterfeit goods, bootlegged media, or replicated branding.
- Firearms, munitions, military equipment, or regulated weaponry.
- Illegal narcotics, prescription medication, and unregistered health supplements.
- Adult entertainment content, explicit material, or human trafficking listings.
- Stolen goods, property under active legal dispute, or fraudulent services.
5. Strict Zero-Tolerance Fraud Policy
- Advance Delivery Fees: Any seller profile found demanding upfront "booking fees", "delivery deposits", or "commitment cash" prior to physical product verification by the buyer will be flagged as an active scam profile.
- Termination Power: We reserve the absolute right to suspend, terminate, or completely delete any account, telephone number, or storefront found violating our safety thresholds without warning. Remaining subscription balances on banned accounts are completely forfeited.
6. Complete Disclaimers & Limitation of Liability
- "As-Is" Distribution: Home and Business Marketplace provides its discovery tools, search indexes, and visibility badges on an "as-is" basis without warranties of any kind.
- Zero Transaction Liability: We explicitly disclaim all liability, legal responsibility, damages, or financial loss resulting from off-platform connections. We are not liable for counterfeit items, bad-faith negotiations, financial fraud, physical theft during handovers, or failure of a seller to fulfill an order.
